| زمینه و هدف: نظر به اینکه مناطق مختلف گردشگری دانشها و کالاها و نمودهای فرهنگی مخصوص به خود را دارند، مالکیت فکری با ایجاد حق انحصاری و حمایتهای حقوقی برای این آثار موجب ارتقا و شناخته شدن برند مقصد گردشگری و حفظ و تجاریسازی این آثار و در نتیجه جذب گردشگر میشود. حمایت از صنعت گردشگری از طریق حقوق مالکیت فکری در حال ایجاد و استفاده از مصادیق آن جهت افزایش ظرفیت بهروری و رونق تجارت در این صنعت متداول گردیده، اما اجرایی شدن آن در این صنعت در کشور ما همواره با موانعی روبهرو بوده است و با توجه به شکاف مطالعاتی در این زمینه در این مقاله به دنبال شناسایی این موانع از دیدگاه متخصصین این حوزه هستیم. روش شناسی: پژوهش حاضر از نظر هدف، کاربردی و به روش کیفی است. با تعداد 18 نفر از متخصصین حوزۀ مالکیت فکری و گردشگری، به صورت نمونه گیری هدفمند و گلوله برفی مصاحبۀ نیمه ساختاریافته انجام شد، تجزیه و تحلیل دادهها با استفاده از روش تحلیل مضمون و به کمک نرم افزار مکس کیودا انجام گرفت. یافته ها: چالشهای موجود جهت بهکارگیری حقوق مالکیت فکری در صنعت گردشگری که در پژوهش حاضر شناسایی شدند عبارتاند از: چالش در ساختار فرهنگی، نظام قانونی، نظام دادرسی، ساختار اجرایی، سیاستهای تدوینشده و چالش در منابع و ابزارهای اجرایی نهادها. نتیجه گیری و پیشنهادات: براساس نتایج تحقیق چنانچه کارکردهایی مانند نظام قانونی، ساختار فرهنگی، نظام دادرسی، مدیریت اجرایی، سیاست گذاری دولت و منابع و ابزارهای اجرایی نهادها بهدرستی انجام نشود، زمینۀ اجرای نظام حمایتی حقوقی در صنعت گردشگری فراهم نمیشود و لازم است سیاستگذاران صنعت گردشگری با شناسایی چالشها و ارائۀ راهکارهای مناسب جهت اجرای مالکیت فکری در صنعت گردشگری زمینه را برای حمایت و توسعۀ صنعت گردشگری فراهم کنند. نوآوری و اصالت: این پژوهش با بررسی چالشها و ارائۀ راهکارهای موجود جهت اجرای حقوق مالکیت فکری در صنعت گردشگری که توسط سایر محققین مورد بررسی قرار نگرفته است، دارای نوآوری میباشد و یافتههای حاصل از این پژوهش به توسعۀ دانش موجود در خصوص ضرورت اجرای حمایتهای حقوقی در صنعت گردشگری کمک میکند. | ||

| Context and Purpose: Supporting the tourism industry through intellectual property rights is becoming established in the country, and using its examples to increase productivity and business prosperity in this industry has become increasingly common. However, its implementation in this industry in our country has always faced obstacles. Given the research gap in this regard, the present study examines the challenges of intellectual property rights in the tourism industry. Design/methodology/approach: The required data for this research was collected qualitatively through interviews with Experts and professors in the fields of intellectual property, cultural heritage, and tourism. It is worth mentioning that the research sampling method was snowball sampling, and ultimately, the results obtained from 18 interviews were analyzed through content analysis using MAXQDA software. Findings: The challenges in implementing intellectual property rights in the tourism industry that were identified in this study include: issues related to the cultural structure, legal system, judicial system, executive structure and characteristics of implementers, formulated policies, and the resources and executive tools of institutions. Conclusion: Based on the research findings, if the identified challenges are not addressed, there will be no foundation for implementing a legal support system in the tourism industry; thus, it is necessary for tourism industry policymakers to identify these challenges and provide appropriate solutions to create the necessary framework for supporting the tourism industry. Originality/value: This research is innovative in that it examines the challenges and presents existing tools for implementing intellectual property rights in the tourism industry, which have not been in previous studies. The findings of this research contribute to developing the current body of knowledge by highlighting the necessity of implementing legal protections in the tourism industry. | ||
