| چکیده | ||
| حق کودکان بر آموزش به عنوان یک حق بنیادین، در اسناد بینالمللی نظیر کنوانسیون حقوق کودک، اعلامیه جهانی حقوق بشر و همچنین قانون اساسی جمهوری اسلامی ایران به صراحت مورد تأکید قرار گرفته است. اهمیت حقوق آموزشی کودکان را میتوان از ابعاد مختلف تبیین نمود؛ این حق، بستر رشد علمی، اجتماعی و انسانی کودکان را فراهم میسازد و آنان را برای مشارکت مؤثر در زندگی فردی و اجتماعی آماده میکند. همچنین، تحقق حق آموزش نخستین گام در حمایت از کودکان به شمار میرود. حقوق آموزشی کودکان نه تنها تضمینکننده رشد و شکوفایی آنان است، بلکه پیشنیاز توسعه پایدار، تحقق عدالت اجتماعی و کاهش آسیبهای اجتماعی در هر جامعه محسوب میشود. بیتوجهی به این حقوق، پیامدهایی چون افزایش فقر، عقبماندگی و گسترش آسیبهای اجتماعی را به دنبال خواهد داشت. با وجود این، حقوق آموزشی کودکان در نظام حقوقی ایران به اندازه کافی تبیین و تضمین نشده و اجرای حقوق آموزشی موجود نیز با چالشهایی همچون طبقاتی شدن آموزش، کمبود منابع و ضعف نظارت مواجه است. در این راستا، پرسشهای اساسی مطرح میشود: گستره حقوق آموزشی کودکان در ایران چیست؟ آیا این حقوق از جامعیت و ضمانت اجرای کافی برخوردار است؟ بررسی نظام حقوقی ایران نشان میدهد که اگرچه حقوق آموزشی کودکان به عنوان یک حق اساسی شناسایی شده است، اما ابعاد مختلف آن، برخلاف برخی نظامهای حقوقی مانند ایالات متحده آمریکا، به طور کامل تبیین و تضمین نشده است. بر این اساس، پیشنهاد اصلاح قوانین موجود و الحاق مواد تکمیلی به آنها، از جمله دستاوردهای این مقاله به شمار میرود. | ||

| Children's right to education as a fundamental right has been explicitly emphasized in international documents such as the Convention on the Rights of the Child, the Universal Declaration of Human Rights, and the Constitution of the Islamic Republic of Iran. The importance of children's educational rights can be explained from different dimensions; this right provides the basis for children's scientific, social, and human development and prepares them for effective participation in individual and social life. Also, realizing the right to education is the first step in protecting children. Children's educational rights not only guarantee their growth and prosperity, but are also a prerequisite for sustainable development, the realization of social justice, and the reduction of social harms in every society. Ignoring these rights will lead to consequences such as increasing poverty, backwardness, and the spread of social harms. However, children's educational rights in the Iranian legal system are not sufficiently explained and guaranteed, and the implementation of existing educational rights also faces challenges such as class-based education, lack of resources, and weak supervision. In this regard, fundamental questions arise: What is the scope of children's educational rights in Iran? Are these rights comprehensive and sufficiently guaranteed? A review of the Iranian legal system shows that although children's educational rights have been recognized as a fundamental right, their various dimensions, unlike some legal systems such as the United States of America, have not been fully explained and guaranteed. Accordingly, the proposal to amend existing laws and add supplementary materials to them is among the achievements of this article. | ||
