| قانون اساسی به عنوان سند بنیادین یک نظام حقوقی و مفهوم کلیدی دانش حقوق اساسی پیچیدگیها و ظرافتهای زیادی دارد که در نظریه حقوق اساسی در مورد آنها بحث میشود. یکی از موضوعات مربوط به قانون اساسی انواع آن و طبقهبندی آن است. در این مقاله یکی از انواع قانون اساسی به نام قانون اساسی موقت مورد بررسی قرار میگیرد. این مقاله با استفاده از روش توصیفی- تحلیلی و با استفاده از مطالعه تطبیقی و تجربه کشورهای مختلف به دنبال پاسخ به این پرسش است که قانون اساسی موقت به چه معنایی است و چه کارکردهایی دارد. قانون اساسی موقت در مواقع مختلفی مانند انقلاب، فروپاشی نظام، استقلال ملی یا پایان جنگ داخلی استفاده میشود و مرحلهای پیشنی برای تدوین قانون اساسی دائمی و اصلی کشور است. این قانون تا زمانی که یک قانون اساسی دائمی تصویب شود بهصورت موقت جایگزین قانون اساسی سابق میشود یا در نبود آن عمل میکند تا زمینه برای تدوین و تصویب قانون اساسی نهایی فراهم شود. قانون اساسی موقت تا زمانی که لغو نشود، به قوت خود باقی میماند. قانون اساسی موقت برای دوره گذار و معمولا توسط نهادهای موقت تصویب میشود و انعطافپذیر است. در این مقاله ضمن بررسی تجربه کشورهای مختلف در استفاده از قانون اساسی موقت، کارکرد و مزایا و معایب این قانون اساسی و همچنین نحوه تدوین این قانون اساسی مورد بررسی قرار گرفته است. قانون اساسی موقت با توافقنامههای صلح که قراردادهایی بین طرفین درگیر برای پایان دادن به یک درگیری خشونتآمیز از طریق آتشبس یا طراحی ساختارهای سیاسی و حقوقی جدید طراحی هستند نسبت نزدیکی دارند که در این مقاله به این رابطه هم پرداخته شده است. | ||

| The constitution, as the fundamental document of a legal system and a key concept of the knowledge of constitutional law, has many complexities and subtleties that are discussed in the theory of constitutional law. One of the topics related to the constitution is its types and classification. In this article, one of the types of constitutions called the interim constitution is examined. Using the descriptive-analytical method and using comparative study and experience of different countries, this article seeks to answer the question of what the interim constitution means and what its functions are. The interim constitution is used in various situations such as revolution, collapse of the system, national independence or the end of a civil war and is a preliminary stage for the formulation of the permanent and main constitution of the country. This law temporarily replaces the previous constitution until a permanent constitution is approved or acts in its absence to prepare the ground for the formulation and approval of the final constitution. The interim constitution remains in force until it is repealed. The interim constitution is for the transitional period and is usually approved by temporary institutions and is flexible. This article examines the experience of various countries in using interim constitutions, their function, advantages and disadvantages, and the way in which they are drafted. Interim constitutions are closely related to peace agreements, which are agreements between conflicting parties to end a violent conflict through a ceasefire or the design of new political and legal structures, and this article also discusses this relationship. | ||
