| چکیده | ||
| تحکیم جایگاه حقوق اقتصادی، اجتماعی و فرهنگی در نظام بینالمللی حقوق بشر، بهویژه در دهههای اخیر، موجب برجستهشدن حقوقی شده است که تحقق آنها مستقیماً با شرایط مادی زیست انسانی پیوند دارد. در این میان، حق بر سلامت و حق بر تأمین اجتماعی بهعنوان دو مؤلفه بنیادین حمایت اجتماعی، نقشی تعیینکننده در تضمین کرامت انسانی و کاهش نابرابریهای ساختاری ایفا میکنند. با وجود آنکه اسناد بینالمللی و تفاسیر نهادهای نظارتی، اشاراتی به ارتباط این دو حق دارند، این پیوند غالباً بهصورت پراکنده و غیرنظاممند مطرح شده و در ادبیات حقوقی کمتر در قالب یک چارچوب تحلیلی منسجم و ساختاری تبیین گردیده است؛ امری که در سطح سیاستگذاری، به گسست نهادی و تضعیف رویکرد حقمحور انجامیده است. مسئله اصلی پژوهش حاضر، واکاوی چگونگی این پیوند در چارچوب حقوق بینالملل بشر و ارزیابی پیامدهای عملی آن برای تحقق مؤثرتر تعهدات دولتهاست. پژوهش با بهرهگیری از روش توصیفی–تحلیلی و با اتکا به اسناد الزامآور بینالمللی، تفاسیر عمومی کمیته حقوق اقتصادی، اجتماعی و فرهنگی و استانداردهای سازمان بینالمللی کار، نشان میدهد که حق بر سلامت و حق بر تأمین اجتماعی واجد بنیانهای هنجاری مشترک، تعهدات همپوشان و کارکردهای متقابل هستند؛ بهگونهای که تحقق یکی بدون استقرار مؤثر دیگری، با محدودیتهای جدی مواجه میشود. تحلیل این مقاله آشکار میسازد که نادیدهگرفتن این همبستگی، بهویژه در شرایط محدودیت منابع، بحرانهای اقتصادی و سیاستهای ریاضتی، به انتقال ریسکهای سلامت به افراد و تضعیف حمایتهای عمومی میانجامد و از این رهگذر، ظرفیتهای حمایتی حقوق بشر را فرسایش میدهد. بر این اساس، بازخوانی یکپارچه این دو حق میتواند مبنایی حقوقی برای بازاندیشی در سیاستهای سلامت و رفاه اجتماعی فراهم آورد. این مطالعه ضمن تطبیق مفاهیم فراملی با مبانی حقوق ملی، خلأهای اجرایی داخلی را در پرتو استانداردهای جهانی واکاوی میکند. | ||

| The progressive consolidation of economic, social and cultural rights within the international human rights framework has, particularly in recent decades, brought to the forefront rights whose realization is intrinsically linked to the material conditions of human existence. Among these, the right to health and the right to social security constitute two fundamental pillars of social protection, playing a decisive role in safeguarding human dignity and mitigating structural inequalities. Despite their recognition as distinct rights in international instruments, legal analyses have largely addressed them in isolation, thereby overlooking the structural and functional interconnections between them—an omission that has, at the policy level, contributed to institutional fragmentation and the erosion of rights-based approaches. The central concern of this article lies in examining the nature of this interrelationship within the framework of international human rights law and assessing its practical implications for the effective fulfillment of States’ obligations. Employing a descriptive–analytical methodology and drawing upon binding international instruments, General Comments of the Committee on Economic, Social and Cultural Rights, and standards developed by the International Labour Organization, the article demonstrates that the right to health and the right to social security are grounded in shared normative foundations, overlapping obligations, and mutually reinforcing functions, such that the realization of one is substantially constrained in the absence of the effective implementation of the other. The analysis further reveals that neglecting this interdependence—particularly in contexts marked by resource constraints, economic crises, and austerity measures—leads to the individualization of health-related risks and the weakening of public support mechanisms, thereby undermining the protective capacity of human rights. | ||
