| نظامهای حقوقی در سالهای اخیر با افزایش حجم دعاوی، طولانی شدن رسیدگی و فشار بر منابع قضایی مواجه شدهاند؛ وضعیتی که بازاندیشی در نقش سنتی دادگاه و مسیرهای حل اختلاف را ضروری ساخته است. این پژوهش با نگاهی تطبیقی به حقوق ایران و انگلستان، بررسی میکند آیا دادگاه میتواند طرفین دعوی را به استفاده از شیوههای جایگزین حل اختلاف (ADR) ملزم کند و حدود مشروع این اختیار در پرتو حق دادخواهی چیست. پژوهش با روش توصیفی-تحلیلی و رویکرد تطبیقی، منابع اصلی هر دو نظام را بررسی کرده و در حقوق ایران اصل ۳۴ قانون اساسی، قانون آیین دادرسی مدنی و قوانین خاص و در حقوق انگلستان قواعد آیین دادرسی مدنی ۱۹۹۸، اصلاحات ۲۰۲۴ و آرای Halsey و Churchill را تحلیل میکند. یافتهها نشان میدهد در انگلستان، طی دو دهه اخیر، ADR از سازوکاری عمدتاً داوطلبانه به بخشی از مدیریت دادرسی تبدیل شده و دادگاهها میتوانند با رعایت محدودیتهای مرتبط با دسترسی به دادگاه، طرفین را به ورود در فرایندهای جایگزین ملزم کنند. در ایران، اختیار عام قضایی برای ارجاع به ADR پیشبینی نشده است. پژوهش بر تمایز میان الزام به ورود و مشارکت در ADR و الزام به پذیرش نتیجه تأکید دارد؛ زیرا در صورت حفظ حق رد پیشنهاد سازشی و بازگشت به دادگاه، الزام به مشارکت، تنظیم نحوه اعمال حق دادخواهی است نه سلب آن. الگوی پیشنهادی برای ایران بر انسجام تقنینی، ارجاع متناسب با ماهیت اختلاف و وضعیت طرفین، مرحلهمندی، حق خروج کنترلشده، تضمین کیفیت فرایند و حمایت از طرف ضعیف استوار است. | ||

| In recent years, legal systems have faced a growing volume of litigation, prolonged proceedings, and increasing pressure on judicial resources, making it necessary to reconsider the traditional role of courts and existing pathways for dispute resolution. This study adopts a comparative approach to the legal systems of Iran and England and examines whether courts may require litigants to use alternative dispute resolution (ADR), and what the legitimate limits of such authority are in light of the right of access to justice. Employing a descriptive-analytical method and a comparative approach, the study examines the principal legal sources of both systems. In Iranian law, particular attention is given to Article 34 of the Constitution, the Code of Civil Procedure, and relevant special legislation; in English law, the study examines the Civil Procedure Rules 1998, the major 2024 reforms, and the decisions in Halsey and Churchill. The findings indicate that, in England, over the past two decades, ADR has evolved from a largely voluntary mechanism into an integral part of judicial case management, and courts may require parties to enter ADR processes, subject to limitations preserving access to the courts. In Iran, there is no general judicial power to refer parties to ADR has been established. The study emphasizes the distinction between requiring parties to enter and participate in ADR and requiring them to accept its outcome. Where parties remain free to reject settlement proposals and return to court, compulsory participation constitutes regulation of the exercise of the right of access to justice rather than its deprivation. The proposed model for Iran is based on legislative coherence, referral tailored to the nature of the dispute and circumstances of the parties, procedural staging, a controlled right of withdrawal, quality assurance, and protection of weaker parties. | ||
